Barkle said it was unclear how DOC became aware of McAlpine's actions but the agency spoke to the defendant about the illegal activity shortly afterwards and he was charged. Prosecutor Stephanie Simpkin said she understood the prosecution was 'relatively rare' but in McAlpine's case it was aggravated by the level of premeditation involved. The May 12 charge followed closely on the heels of McAlpine's previous conviction, she said, and she sought a term of community work to mark the repeat nature of the offending. Lawyer Paul Keegan said money had been the primary motivator for McAlpine on this occasion. 'He took the money because he's hard-up,' he said. McAlpine underwent a double hip replacement in February this year, which has compromised his mobility and ruled out any further offending of a similar nature, Keegan said. 'He's physically unable to do this anymore. 'He's been up that mountain 1500 times but that has ended,' Keegan said.
